Booking terms and Conditions

Please read carefully the terms and conditions outlined on this page. Any individual or corporation undertaking contractual business with the Artiste, John King, assumes full acknowledgment of these terms, without exception.

 

DEFINITIONS

The "Artiste" means John King.

The "Client" means the individual or corporation by whom the Booking is being made.

The "Booking" means the specific reservation of the Artiste's services, for a particular event, to be held on a particular date, by the Client.

The "Date" means the specific day, reserved for the Artiste's services, by the Client.

The "Services" means the actual presentation(s) and/or performances(s) delivered by the Artiste.

BOOKING PROCESS

Prior to booking, the Artiste will provide the Client with a quote for the total cost of all services required.

A payment of either a deposit or the full booking fee is required in order to book the services of the Artiste.

Payment of either the full booking fee or a deposit is indication the Client accepts the terms and conditions of this document and wishes to confirm the booking.

The specific date requested by the Client is not held by the Artiste until the agreed booking fee or a deposit has been paid. Until such times the pertaining date is still available to other clients, without liability to the Client.

 

BOOKING FEES, DEPOSITS AND BALANCE PAYMENTS

The price of a deposit may vary.

In the event the event that a deposit price is not specified, the deposit price should be considered as 30% of the total cost of services.

The deposit paid by the Client is to secure the Artistes time on the agreed date and is non-refundable regardless of any circumstances.

Payment for the remaining balance should be made no later than 10 days prior to the booking date.

The Artiste has the right to request full payment before commencing any services.

All payments are required in Pounds Sterling.

 

CANCELLATIONS AND CANCELLATION FEES

In the event that the Client has to cancel a Booking, the Client is required to notify the Artiste, via email, immediately.

As a result of such, the Client will forfeit the deposit paid and additionally they will be liable to pay cancellation charges as follows:

i) Cancellation over 60 days prior to the Event Date: No Fee.

ii) Cancellation made 30-59 days prior to the Event Date: 50% of Total Invoice.

iii) Cancellation made less than 30 days prior to the Event Date: 100% of Total Invoice.

In the event the Artiste has to cancel a Booking, the Artiste shall have no further liability to the Client in relation to any part of the Contract.

 

MAKING CHANGES TO BOOKINGS & RESCHEDULING A BOOKING

In the event that the Client requests to make any changes to a Booking, the Client is required to notify the Artiste, via email, immediately.

Acceptance of any changes or rescheduling of a booking is at the discretion of the Artiste, may be subject to additional costs and may be subject to additional terms and conditions.

If the request is declined by the Artiste and the booking is unable to proceed as previously agreed, the booking will be considered as being cancelled by the Client.

If the change requested is a date change, a rescheduling fee of £75 is due each time a booking is rescheduled. 

Bookings cannot be rescheduled to an unknown date. If a booking is to be rescheduled, a new date must be given at the point of requesting to reschedule the booking.

SERVICES

If in the unlikely event the Artiste feels that they or their equipment is threatened or in danger in any way, the Artiste has the right to leave the event without providing Services.

The Artiste has the right to hand out promotional material on a Booking Date, unless specified otherwise in advance by the Client.

The Artiste has the right to record video or take photos at the booking and use any of these for promotional material or any other purpose.

The Artiste will need to be at the venue prior to the event. The amount of time required may vary.

The Artiste will require at 1 parking space for the duration of the event at the venue. This parking space should be free from height restrictions and suitable for a long wheelase van to load/unload equipment. Parking fees, if applicable, are the responsibility of the Client.

If any parking restrictions exist such as residents parking, pay and display, or time limits, the Client should advise the Artiste of this prior to booking your event.

The safety of all guests is the sole responsibility of the policy holder, who must be 18 years or above.

EVENT CONTENT CREATION (PHOTOGRAPHY & VIDEOGRAPHY)

When capturing events, The Artiste will capture photos and/or video clips reacting to the circumstances as appropriate at the event.

If the client has any unusual requirements, shot lists or any other specifics that are required to be included in the content provided these need to be agreed upon before an event. Some requirements may be subject to additional costs. Changes requested to delivered photos/videos may be chargeable.

Outwith pre-agreed specifics, all other capturing, editing and creative decisions are made entirely by The Artiste.

Following the event, the content captured will go through an editing process, following which the content will then be provided as a digital download from the downloads section of the John King Events website. 

By default, media is provided in standard JPEG and MP4 formats. Unless otherwise specified, video is provided in 1080p HD. By default, photographs taken will be in a candid style with subtle effects applied where appropriate. 

By default our event videos will tell the story of an event comprised of various clips captured throughout the event, largely set in chronological order, occasionally with musical overlays and subtle effects where appropriate.

Any music overlays will be royalty-free and chosen by The Artiste. We cannot include music overlays that we do not have legal permission to use. 

The Artiste owns the copyright of any created content and grants permission to The Client to use any content created for them for any purpose.

The Artiste will make created content available for up to 6 months for the Client to download. Following this, the Artiste's copy and working files may be deleted.

LIABILITY


The Artiste is takes the utmost care to ensure the safety of all event guests, the Artiste will only use high quality products and follows strict hygiene routines.

Liability cannot be taken for reactions or injury sustained whilst attending an event or thereafter. All allergies, ailments, infestations or viruses of guests or clients, which may affect the event in any way, must be reported prior to the event date. The Artiste cannot accept liability for actions outside of the Artiste's control to include hazards/dangers within the home or chosen venue.


FAILURE OF THE CLIENT TO FULFIL CONTRACT

In the event that the Client fails to meet any of the terms and conditions laid out in this agreement, the booking will be considered as being cancelled by the Client.

Should this happen during the event, the Artiste has the right to leave the event without providing Services.


FAILURE OF THE ARTISTE TO FULFIL CONTRACT

In the event that the Artiste is unable to provide the agreed service, the Artiste can choose to cancel the booking or endeavour to provide an alternative service to serve as a replacement if possible.

In situations where the Artiste is unable to provide the agreed service through no direct fault of their own, a refund of all moneys shall be paid to the Client excluding the deposit. This can include events such as accidents, war, terrorism, mechanical failure of the Artiste’s vehicle, being stopped/detained/arrested by police, dangerous or extreme weather conditions, earthquakes, government rules or restrictions, plagues/epidemics/pandemics, unforeseen loading or parking restrictions, road blockages or other transport restrictions or any force majeure or act of God event.

In the event the Artiste is late or is unable to provide the agreed service due to a health-related issue or is otherwise the fault of the Artiste, the deposit and all monies will be paid back to the Client or alternatively provide a partial service for a shorter time period. Should this occur, the booking fee will be reduced by the percentage of time lost. i.e. For a 2 hour booking where only 1 hour can be provided, 50% of the total booking fee would be due.

Following the cancellation of the booking, the Artiste shall have no further liability to the Client in relation to any part of the Contract.
